New to the forum - has anyone a leaseback at Samoens. Would be interested to hear from them. Just received letter today advising the Paris Commercial court made a decision 28 September for soderev to be placed under a safeguard procedure. Its says for the shorter term, rents will be paid on a prorata temporary basis! Guess that means we get very reduced rent if any!

A quick message for Justme.
I am an owner at Les Fermes de Samoens and have just come across this site having received a few days ago my letter from Soderev.
I am very interested to join a group action, as having suffered this problem on two other leasebacks strongly believe that a solid and unified group with legal representation is the only way to proceed with any chance of success.
I have been trying to send my details to Justme via PM, but keep getting the message rejected as your PM mail box is full. Any chance you could empty some messages so that I can get my details to you and added on to the group list for LFDS.

I did just post a message on the Samoens Owners – Joint Action thread.
Basically of the three leaseback properties I own, two including Samoens have ongoing problems and are at the start of attempting to get things resolved. With the third, and hopefully the worst, Les Jardins D’Elisa (Beausoleil), the problems started back in late 2007 / early 2008 and the action group are still trying to resolve the remaining issues now (build quality and syndicate).
I suppose a major difference there was that it took a while for an action group to form and even then there were two or more groups all pushing for different agendas. So with Samoens it is very good to see that a group is forming so quickly and seems to involve most of the owners. I am not sure how far they got, but some of the owners where looking to sue the French selling agents for misrepresentation etc.
The key elements for success seem to be a united group of owners represented by an agreed and dedicated panel of representatives. Must be ready to take our time to achieve a good result and not be bullied into a speedy settlement. Fully understanding the issues and options available to the group. Use by the group of a good French (bilingual) lawyer, knowledgeable about leaseback and who has no hidden agenda and is not connected to any of the other parties involved like Le Grange and its many subsidiaries. The obvious benefit of the group using a lawyer is economies of scale with fees. This legal advice will stretch to all issue like syndicate etc.
