There is a demand for Odalys leasebacks. Please use the “SELL MY LEASEBACK” option if you are interested. Note if you do sell during the lease you will likely receive less than you paid, but the law has changed so you no longer have to pay back the VAT which was initially refunded to you when you first bought the property and the buyer pays all legal fees.

Odalys are still considered secure, so all residences are (in theory) saleable. Naturally common sense applies - if you think the location is particularly attractive then buyers will too!

Dear Seamus, 

 

What is the legal reference to which you are referring please? The French lawyer on a leaseback I own has recently looked into the refund of VAT and is of the impression that the VAT still needed to be reimbursed unless the property was going to be kept as a tourist residence/rental - I would like to send him the details of the law you refer to.

Your lawyer is correct. You do not repay the original VAT if you sell as a leaseback i.e. the buyer simply takes over your lease, but you do repay the VAT if you break the lease and sell as a normal property. In the latter case you pay what is outstanding based on 20 years pro-rata remaining. I'm afraid I do not know the legal article number.
