But to go to the court is going to be much more expensive to you that what you will win. Odalys takes advantage of this situation.
I cannot that you advise to group together into an association to make value your of.

24 April 2015I agree with the comments by Phib. I spoke to my local Notaire about the topic, it will take long time and will be to expensive to use a lawyer. The alternative and only solution will be to use the Bailif (French Huissier in the area you have the apartment) if you think you have not received what you should have by Odalys. However, if the situation is the same for all we should do it together as a massive claim.

24 April 2015Thank you @tom.beglin for your information. @Licorne and @PhiDe: You are right that it is very expensive for an individual to start a legal procedure against a big company like Odalys. I would certainly join a massive group of co-owners if their would be one. Howeve I'm affraid that that will not happen. I have also posted my mail on the Facebook site Odalys Proprietaires and received a few responds from people who also want to start a procedure. Most of the owners have the same problems with Odalys, which is that they are always to late with the rent paiments. I have already involved a Bailiff for the rent arrears and Odalys paid the outstanding rent within a month. But not the indexation over the past 6 years. If I will not do anything about it my guaranteed annual rent will remain on the same level for the coming years and I will lose a substantial amount.

If you stop the lease it will become difficult to sell it due to the high maintenance costs (maintain swimming pool, cleaning staff, guardian etc).
I suggest talking to a French leaseback specialist like us before spending money with a solicitor, @Sextant we do have investors interested by the lease contracts so it is an easier path to sell your property.

We were in a different situation where Odalys wanted to drop the rent and when not enough people tok up their offer they decided to exit the lease.
If this looks like happening they will give you a year's notive and they will continue to be slow paying up.
The good news is that there is life after Odalys. Ironically your apartment, depending on where it is and whether it is attractive to the local population as a place to live full time may be worth more outside of a lease. There are lot of challenges including having to payback the VAT rebate and getting someone else to rent out the apartment. you also have to replace SGIT Gestion with a new syndic of your choice.
My advice is to stick together and try and establish as soon as you can Odalys's intentions for the end of the lease....Are they looking for a rent reduction, are they looking for loads of money for renovations....at the same time try and figure out what market there is locally for your apartments. It would be a shame spending a lot of money to throw them out if they are lookingn to leave of their own accord!
Finally, don't count on being able to rent for anything like the same amount or season that Odalys did. The rental market is very poor this year and there is serious downward pressure on prices.

I like to know more about Sextant. Odalys has offered the owners an extansion on the Bail in 2012 and all owners have agreed on a new 9 years term, without rent reduction and including refurbishement by Odalys. It seems obvious that Odalys is happy with Les Greens du Bassin. But after signing the Avenant Odalys started late payment of the rent. That occured to be an issue for most of the locations. However this year Odalys is paying in time. I have sent them a Mise en demeure on the 3th of this month and I received the payment for the last 3 months on the 5th. The only problem I still have with Odalys is that they did not indexed the contactual rent as from 2007 and the lack of communication. Other owners have received an index on the rent. I am the only one who has not received an index on the rent. Letters to the Service Propriétaires, Mrs Guidicelly, Mr. Mazoyer and Mr. Mariette remain unanswerred. So, I have decided to sell the house. I was informed that without Bail the market price of my house is 20% higher than with Bail. But unfortunately the Bail will continue for 6 years (November 2022).
