hi there. I have recently joined forum. we have leaseback in nice with odalys.everything nas been going fine except we have been getting alot of bills which i feel we shouldnt be paying.was under impression that odalys should be paying for everything. looking forward to hearing from eh. regards marty

20 September 2010This is a real mine field as the property has to be fit for the purpose that you leased it out for.
Odalys normally write something in to their lease to say that they are not responsible for the buildings structure or defects.
This way they are quite within their rights to bill for any works required to bring the building up to standard to be fit for the purpose you leased it to them for.
If you refuse to pay? Well my guess is that they will take you all to court and take it out of your rents anyway.
Odalys took over the Jardin D'Elisa in Beausoleil as well as a few others and they are just about to appoint their own Syndic. In places one of the buildings has water leaking inside, damp and floods. My guess is that the Syndic will be hot on the case of this and investigate these as it could affect their income. Why should they pay for it? My argument is simple, I did not put Odalys in the building, I did not renew my lease with them or appoint their Syndic so why should I pay their bills? If there business is profitable or not has no affect on my rent and I really could not care less.
My guess is if your signed up with Odalys then your gonna have to pay but read your lease just in case.
