Hi

I was wondering if anyone else is experiencing late payments from Accelis. I had a late payment for the first installment January and as yet no April Payment. Any feed back gratefully appreciated.

Yes

 

Same experience. January payment was about 10 days late. No April payment yet. This happened once before a couple of years back, but did resolve itself at the time. I was planningt o follow up next week if no payment received before then.

Same here.  I was paid on 2nd Feb, but nothing in April.  I don't have eBanking in France so won't see if I get paid till later in May.

TBH, it's happened to me before and it got paid the following month - they're not the worst for paying.

I contacted Accelis also last week and asked about the 11 year lease and Antoine  informed me 'it just rolls over'!

It is unfortunate that we do not have an owners representative anymore. (The lease should have been reviewed evry three years). The last person upped sticks and sold his property.

There is a very interesting article on the Forum entitled life after leaseback. Essentially we are not in a favourable postion even post Brexit!

I trust you have all received latest proposition of rent reduction 50% or resell. Any ideas of a joint response/ way forward?

I have decided to seek legal advice and not except a reduction in rents. Another month of late paying!! I assume no other owners have had a letter about renovations due.

I've received the correspondence from Accelis proposing a yield of 2.5% and seeking willing sellers (no doubt at reduced values).

No sign of July rental payment yet.

Hi All

I don't appear to be getting notifications of any updates to this site on the Paxton or Accelis Gestion topics, so I just happened to search the topics today and saw the various comments regarding the lease and reduction in rents.

I just got the letter proposing a reduction to in rent 2.5% and the option of selling.

Not sure what would happen if we refuse the reduction................

I never really thought much about the studio in Paris until I received the notification regarding the reduction in rent and the new agreement to be signed and take effect on October 1st. can I ask what other owners of these apartments are doing regarding this?  Thanks a mill for any information.

The other owners are resisting a rent reduction. I finally got my rent today two months in arrears !!!

I notice rent has still not been paid again from January seems to be getting later and later since the letter of reuction!  Has any one else been paid or reduced their rent.. Graham

 

 

 

Still did not get paid for the last quarter which should usually arrive in January. Is this what you mean Graham?

I phoned on Friday and was promised some kind of payment this week.

I am still resisting the rent reduction and would not wish to sell at such a loss of initial investment.

Only received half the rental also - getting legal advise now re the next steps/options open to us.

We may need to consider a group action.

Hi Kathrina 

Yes we phoned Friday and were informed that I would have an e-mail response as to proposed plan to repay the other half of the rent! I explained that in two weeks I would be owed another three months rent. I think that is when I would pay for a CDP (Commandement de Payer) .

It seems that only a select few have been penalised late / half rent so unified action is sketchy. I am convinced that Accelis are tacticaly calculating their straergy to squeeze selective owners.The difficulty with a forum is you have to wait for responses.

I sought legal advice but thought the initial consultation of eu 1000 was too expensive so am in 'no mans land' at present. It would be good if we could somehow unite with other owners.

So the situation is a number of co-owners have signed a new lease with the reduced rent and a number have not yet signed. Regardless, The new rent is not decided by the management company; the commercial lease framework provides that the lease is renewed at the rental value of the premises. Therefore if the rental value is higher than the offer made by the management company, the owners are able to force the management company to renew the lease at the rental value. 

So do you have anyone representing the residence who is working with someone to do this?

Someone needs to co-ordinate owners so you can make a joint decision. If you do nothing then the management company will try to do what they like. If you want to try to fix things then communicate with each other. If most believe that the proposed rent is too low (this is the view of an independent professional french buyer) then if you agree to take action an expert will assess the rental value and force the management company to change the lease to the assessed rental value. Even if a group of you could conference call our legal rep he would discuss options. If the options were favourable then you are legally entitled to request contact details of all co-owners and our legal rep would write to all with proposals.

But do not sell at the reduced price.

Can you advise of a good Leaseback legal advisor to contact re: advice on ’Accelis issuing an Addendum to reduce the rent significantly (backdated to 2017!!)? Plus, non-payment of rent!
