Our leaseback was repossessed and sold at auction in October 2014. Huge shortfall but we just couldn't keep up with all the changes and fees. Assumed the bank would take the small sum received at auction but didn't hear anything until last week. Received an amicable agreement document outlining payment priorities and sum payable to debtor, merely 28k but thought the bank had claimed it. Seems they failed to submit 2 updates in the process and forfeited their surity. Other document however was an attachment of a sum of money into the hands of a third party which we assume is the bank handing over our outstanding arrears to a French bailiff? Not sure really or where the 28k is as we could off this to the bank. No uk collateral and thought of statute barred as an option. Anyone any advice? 9 long stressful years.
